Terms of Use
The terms governing use of the public website and secure agent portal.
1. Acceptance of these terms
These Terms of Use ("Terms") are an agreement between you and Western Surplus Lines Agency, Inc. ("Western Surplus," "we," "us" or "our"). By accessing or using westernsurplus.com, including its secure agent portal, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the website.
You represent that you have legal capacity to agree to these Terms and, if using the site for an agency or organization, authority to bind that organization.
2. Agent accounts and security
Secure-portal access is limited to users approved by Western Surplus. You must provide accurate information, use only your own account and access only producers and records that you are authorized to view.
You are responsible for safeguarding your password, passkeys, multifactor-authentication methods and recovery codes. Do not share credentials or allow another person to use your account. Notify Western Surplus promptly if you suspect unauthorized access, an incorrect producer assignment or another security issue.
We may require password resets, multifactor authentication or other safeguards, and may suspend or terminate access when reasonably necessary to protect the site, comply with law, address inactivity or enforce these Terms.
3. Permitted use
You may use the website only for lawful business purposes related to your relationship with Western Surplus. You may not:
- access or attempt to access another user’s account, producer records or restricted systems;
- circumvent authentication, authorization, rate limits, bot protection or other security controls;
- scrape, harvest or use automated tools to extract site content or personal information without written permission;
- upload or transmit malware, harmful code or material that violates law or another person’s rights;
- probe, scan, test or disrupt the website or its connected systems;
- misrepresent your identity, authority, agency relationship or intended use; or
- copy, modify, distribute or commercially exploit site content except as authorized by Western Surplus or applicable law.
4. Insurance information and documents
The website provides business information and tools for convenience. Product descriptions, carrier information, appetite statements, financial-strength ratings and similar content are general information only. They are not an offer, quote, binder, guarantee of coverage or professional advice. Availability and terms vary by risk, market, jurisdiction and underwriting review.
Only a policy, endorsement, binder or other document issued or expressly authorized by the applicable insurer can establish coverage. If website content conflicts with an issued insurance document or Western Surplus’s official records, the issued document and official records control.
Electronic policy, invoice, statement, expiration and production information is provided only for authorized assigned producers. You are responsible for reviewing downloaded documents for completeness and accuracy, protecting them from unauthorized disclosure and delivering them only to an appropriate recipient through a secure method.
5. Third-party services and links
The website may link to or connect with third-party services, including payment, carrier, document and security services. Those services are operated by their respective providers and may have separate terms and privacy policies. A link or connection does not mean Western Surplus controls or endorses every aspect of the third-party service.
Payment transactions initiated through ePayPolicy are processed by that provider. Do not send payment-card or bank-account information directly to Western Surplus through public website forms or ordinary email.
6. Intellectual property
The website, its design, text, graphics, logos, software and other content are owned by Western Surplus or used with permission and are protected by applicable intellectual-property laws. Western Surplus grants you a limited, revocable, nonexclusive and nontransferable right to use the site for its intended business purposes. No other rights are granted.
Carrier names, logos and trademarks belong to their respective owners.
7. Privacy and electronic communications
Our Privacy Policy explains how we handle information through the website. By using account and access-request features, you consent to receive transactional electronic communications related to account setup, authentication, security and service administration.
8. Availability and disclaimers
We work to keep the website accurate, secure and available, but the site may occasionally be unavailable or contain errors. To the fullest extent permitted by law, the website and its content are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, title and noninfringement.
Western Surplus does not warrant that the website will be uninterrupted, error-free or free from harmful components, or that all information will always be current or complete.
9. Limitation of liability
To the fullest extent permitted by law, Western Surplus and its officers, directors, employees and agents will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of data, revenue, profits or business opportunity, arising from or related to your use of or inability to use the website.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
10. Your responsibility
To the extent permitted by law, you agree to be responsible for losses, claims and expenses arising from your misuse of the website, violation of these Terms, unauthorized disclosure of information obtained through your account or infringement of another person’s rights.
11. Governing law
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute arising from these Terms or the website will be brought in a state or federal court with jurisdiction in Taylor County, Texas, unless applicable law requires otherwise.
If any provision is found unenforceable, the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. These Terms, together with policies expressly incorporated here, are the entire agreement concerning use of the website.
12. Changes to the site or terms
We may modify, suspend or discontinue website features and may update these Terms. The effective date at the top identifies the latest revision. Continued use after updated Terms take effect constitutes acceptance of the revised Terms.
